ON MAKING SUPPLEMENTS TO THE CONSTITUTIONAL LAW “RULES OF PROCEDURE OF THE NATIONAL ASSEMBLY”

Article 1. Article 109 of the Constitutional Law "Rules of Procedure of the National Assembly" dated December 16, 2016 LA-9-N (hereinafter - Law) shall be supplemented with part 4.1 of the following content:
“4.1. An application to terminate of the powers of a judge of the Constitutional Court on the grounds of a substantial disciplinary offense may be based on materials provided by the Commission on the Prevention of Corruption.”
Article 2. In the article 141 of the Law:
1) paragraph 4:
1.. after the words "documents certifying the provision of the requirements established by the Constitution and the law" shall be added the words, "as well as the questionnaire filled by the candidate regarding the issues of correct behavior;"
2. shall be supplemented with a new sentence with a following content: “In case the requirements of the Constitution and laws are provided, the Chairperson of the National Assembly within a working day shall submit the filled questionnaire regarding the correct behavior to the Commission for the Prevention of Corruption in order to receive an consultative conclusion on it within ten days.”.
2) Paragraph 6 shall be amended as follows:
“6. The issue on election of a judge of the Constitutional Court shall be debated in accordance with the procedure prescribed by paragraph 5 of Article 136 of the Rules of Procedure after the nomination of the candidate at the forthcoming regular sitting of the National Assembly, within the term that shall provide the consultative conclusion by the
Commission for the Prevention of Corruption, prescribed by paragraph 4 of this article regarding a candidate for a judge of the Constitutional Court.”.
Article 3. In Article 144 of the Law:
1) paragraph 2:
1. after the words "documents certifying the provision of the requirements established by the Constitution and the law" shall be added the words, "as well as the questionnaire filled by the candidate regarding the issues of correct behavior;"
2. shall be supplemented with a new sentence with the following content: “In case the requirements of the Constitution and laws are provided, the Chairperson of the National Assembly within a working day shall submit the filled questionnaire regarding the correct behavior to the Commission for the Prevention of Corruption in order to receive an consultative conclusion on it within ten days.”.
2) Paragraph 6, after the words “after the expiry of the term of nomination of candidates,” shall be supplemented with the words “: at the terms that shall provide the consultative conclusion by the Commission for the Prevention of Corruption, prescribed by paragraph 2 of this Article regarding candidates for members of the Supreme Judicial Council.”
Article 4. This Law shall enter into force on the tenth day following the day of its official promulgation.
