Addendum to RA Law on Non-Commercial State Organizations

On June 30, the extraordinary session of the National Assembly was convened by the initiator’s established agenda.

The Parliament debated in the first reading the draft law on Making Addendum to the RA Law on Non-Commercial State Organizations authored by the NA deputies Mkhitar Hayrapetyan and Hovhannes Hovhannisyan.

It is proposed by the draft to add the above-mentioned law with a new part, according to which, other basis for termination of authorizations of a person appointed to the position of the executive body or appointed to the position of the executive body as a result of the election by the decision of the competent authority can be set by the law.

The proposed amendment will provide an opportunity to set visible criteria for increasing the efficiency and accountability of the activities of the SNCO directors by the laws regulating the relevant spheres.

According to the current law, the authorized bodies do not have an opportunity, depending on the specific features of the field, to establish other basis for termination of the director’s authorizations. The mentioned circumstance reduces the role of the authorized bodies, from the point of view of measuring the efficiency of the directors’ work and increasing it.

The key rapporteur Hovhannes Hovhannisyan, presenting the urgency of making addenda to the law, has noted that there are litigations which have arisen due to the openness of the law.

Heriknaz Tigranyan presented the endorsement of the NA Standing Committee on Health Care and Social Affairs by the co-report. It was stated that editorial proposals were presented in the Committee, which were accepted.

The Deputy Minister of Justice Suren Grigoryan introduced the endorsement of the Government. It has been noted that the bill has been revised based on the proposal of the executive body, so the Government has no objection.
