Inspection Body May Not Comply with Three-day Notice Requirement If Only Hidden Labor is Discovered

The RA Health and Labor Inspection body must inform the inspected economic entity about the scheduled inspection. This makes inspections predictable for the inspected economic entity, he/she becomes more protected. The inspection body also carries out an inspection of the legitimacy of the employment contract or its existence, the hidden labor, and in this case the three-day notice makes the inspection pointless. According to our proposed amendment if only the hidden labor is discovered, the inspection body may not comply with the three-day notice requirement. The deputy Heriknaz Tigranyan informed about this presenting the legislative draft authored by her and the deputy Narek Zeynalyan.

The key rapporteur informed that according to the law, there exceptions to the three-day time limit. “When you give three-day notice that you are coming to check, including the hidden workforce, those who work without a contract will naturally not come to work that day. Therefore, the real picture will not be recorded, it will not be clear how many shadow workers there are. This is the case when the exclusion of the three-day period is justified.”

On September 12, the parliament debated in the first reading the draft law on Making Amendments to the Law on Organization and Conduct of Inspections in the Republic of Armenia.

The NA Standing Committee on Economic Affairs endorsed the draft. The co-rapporteur Hovik Aghazaryan emphasized the importance of the adoption of the draft.

Artur Asoyan, the Head of Inspection Bodies’ Coordination Bureau of the Office of the RA Prime Minister, presented the positive opinion and proposals of the Government.

The parliament also debated the draft law on Making Addenda to the Law on Local Self-Government. It is proposed to delegate the powers of amending and adding the acts, which preserved their legal force, adopted by regional, city, township and village councils and their executive bodies, as well as recognizing them as invalid, to the heads of communities. The RA Deputy Minister of Territorial Administration and Infrastructure Vache Terteryan presented the main changes.

Matevos Asatryan, a member of the Standing Committee on Territorial Administration, Local Self-Government, Agriculture and Environment Protection, presented the endorsement of the Committee.
