It will be possible to provide the proper reservation of the criminal proceedings with legislative amendment: presenting in the first reading the draft law on Making Amendments and Addendum to the RA Criminal Procedure Code,” the NA deputy Lilit Minasyan said.

The issue was debated at the extraordinary sitting of the NA Standing Committee on State and Legal Affairs on June 26.

According to the key rapporteur, there are regulations in the Article 8, as well as in a number of other articles of the Code, according to which, the recording USB of the proceedings actions are attached to the relevant protocol. It is proposed to use server infrastructures for preserving the data subject to reservation in electronic way, and it will essentially decrease the expenditures in the investigative bodies.

“Taking into consideration the fact that we should be led by the strategic goals of reform for the formulation of the need of the infrastructures necessary for recording and preservation of data, it should be noted that conditioned by the degree of sensibility of infrastructures, it is more purposeful to observe the model of preserving them in the server infrastructures,” Lilit Minasyan said.

According to the co-rapporteur Alkhas Ghazaryan, proper reserving way of criminal proceedings is designed by the draft.

The representative of the Government the RA Deputy Minister of Justice Ara Mkrtchyan, noting that the Government is for the draft, underlined that an important is taken in the pre-examination sphere and essential reforms are made. From September 1, 2023 the pre-examination should be fully carried out in electronic way.

The Committee Chair Vladimir Vardanyan inquired how the security environment will be provided and will the servers be in the territory of the Republic of Armenia outside. Ara Mkrtchyan informed that in security aspect the international influential ISO 27 00 standard is used: the present technical solution will provide the use of that standard. And the cloud server economy, where the recordings of the investigative actions will be preserved, will be in the Republic of Armenia.
