Initiative clarifies issues regarding management of gifts given to public servants and persons holding public positions

According to the RA Deputy Minister of Justice Karen Karapetyan, the legislative initiative proposes to establish regulations concerning the management of the property received by the public servants and persons holding public positions which became state property.

It was noted that the range of gifts considered permissible by the law on Public Service will be specified, including the property provided as a reward or state award.

According to the Deputy Minister, it is also proposed to endow the State Property Management Committee with the authority to manage gifts.

It is also proposed to clarify the range of gifts considered permissible with the law on Public Service with the package of drafts, including the property provided as a reward or state award.

The deputies’ questions were related to the notion of ‘gift,’ the responsibility for hiding the gift.

During the exchange of ideas, the Deputy Chair of the NA Standing Committee on State and Legal Affairs Arusyak Julhakyan emphasized the introduction of control mechanisms. It was mentioned that rules of conduct should be inculcated in officials.

The Committee Chair Vladimir Vardanyan underscored the necessity to change the environment and the people’s behaviour. According to him, common sense is the basis of the legal regulations. Ensuring the transparency of receiving gifts has also become important.

The co-rapporteur, the deputy Alkhas Ghazaryan, highlighting the adoption of the legislative package, called on her colleagues to vote for it.

As a result of debate, the Committee members endorsed the legislative initiative.

The draft law on Making Amendments and Addenda to the Law on State Property Management and the package of the attached drafts were debated in the first reading at the regular sitting of the NA Standing Committee on State and Legal Affairs on November 23.
