Parliamentary Hearings on Draft Law on Making Amendments and Addenda to the Constitutional Law the RA Judicial Code and on Package of Co-Draft Laws

On February 25, on the initiative of the RA NA Standing Committee on State and Legal Affairs parliamentary hearings on the debate of the draft law on Making Amendments and Addenda to the Constitutional Law the RA Judicial Code and the package of co-draft laws.

The RA NA deputies, representatives of the judicial power, civil society, lawyer scientists, experts and the persons interested in the sphere.

The Committee Chair Vladimir Vardanyan made opening remarks. Highlighting the necessity of the judicial system the speaker has noted that the judicial power is the basis of the creation of the legal state, the protection of human rights, the stable and the lasting development in accordance with the international standards cannot be guaranteed. According to the speaker, the judiciary reforms serve as one of the most important havens of democratic Armenia.

The RA Minister of Justice Rustam Badasyan presented the main provisions of the draft law on Amendments and Addenda to the Constitutional Law the RA Judicial Code and the co-draft laws.

Rustam Badasyan informed that the package was debated and public debates were organized on them with the participation of the stakeholders, during which numerous recommendations were received. The Judicial Code was undergone international examination, and the positice legal opinion of the Venice Commission.

According to the package, the number of the members of the Ethics and Disciplinary Committee was changed.

The RA Minister of Justice noted that new mechanisms of the election for judges' candidates were established by the package of the draft laws.

Welcoming the holding of the public hearings the RA Human Rights Defender Arman Tatoyan noted that in the Republic of Armenia the implementation of the judicial power: in accordance with the Constitution and laws, and the implementation of the state power on the basis and division of the legislative, executive and judicial powers should be guaranteed.

The Member of the Supreme Judicial Council Vigen Kocharyan has informed that constructive debates on different bills are always held with the RA NA Standing Committee on State and Legal Affairs.

The Chairman of the Appeal Court Yervand Khundkaryan has assured that the representatives of the judicial power are also concerned about raising the problems impeding the progress of the judicial power and try to solve them.

The speakers answered to the participants' numerous questions.

The Chair of the RA NA Standing Committee on Protection of Human Rights and Public Affairs Naira Zohrabyan touched upon the reasonable terms of the judicial sittings, noting that sittings in the courts extend for many years.

The RA NA deputy Arman Babajanyan highlighted the diagnosis of the system disease.

The RA NA deputy Taron Simonyan has noted that he has more than 30 recommendations on the bill.

The RA NA deputy Suren Grigoryan has stated that the judges do not correspond to today's landmark, if they don't get acquainted with judgments of the European Court.

In her speech the Deputy Chair of the RA NA Standing Committee on State and Legal Affairs Anna Karapetyan emphasized the independence of the courts noting that the democracy could not develop without judicial power.

In his final speech the Minister of Justice Rustam Badasyan touched upon the voiced viewpoints and speeches and gave clarifications.

In his concluding speech the Chair of the RA NA Standing Committee on State and Legal Affairs Vladimir Vardanyan thanked the participants of the hearings for the presented opinions and gave clarifications to the voiced concerns.
