Working Debate at NA Standing Committee on Labor and Social Affairs

On March 24, the Chair of the NA Standing Committee on Labor and Social Affairs Heriknaz Tigranyan and the Committee members Mariam Poghosyan, Gayane Yeghiazaryan and Aghvan Vardanyan met with the Representatives of the American Chamber of Commerce in Armenia.

The basis of the working debate was the draft of the Labor Code, which was debated in the NA sitting last week and adopted in the first reading, within the framework of which some issues arose that, according to the representatives of the business sector, need to be regulated.

According to them, the adopted version needs to regulate the under regulations or they are so that during practical application they can be problematic for the flexibility of employer-employee relations in the future to establish a ban on terminating the contract on the basis of retirement age in the Labor Code. This gives the employers at the same time opportunity and freedom to evaluate the practical characteristics and professional qualities of the employees who have reached the retirement age and, accordingly, to continue the working relationship with them, as well as to evaluate their abilities, which means that the employees are given the opportunity to express themselves as much as they can.

The concerns of the business sector representatives, in particular, were related to the fact that in the case of such a regulation, it will be more difficult for the employers to define any evaluation criteria and subject the employees to certification. They propose to establish a list in which people who have reached the retirement age are not included, taking into consideration the dangers and risks of these jobs, to define the possibility of working under a certain contract or to revise the working hours. It has also been proposed to make regulations regarding working on weekends, depending on the regulation of working hours and remuneration.

Heriknaz Tigranyan mentioned that they will debate the proposals with the colleagues of the executive body. According to her, if appropriate solutions are found from the first to the second reading, they will be implemented in the second reading, if deeper regulations are assumed, perhaps these amendments will be addressed later.
