The NA deputies Armen Khachatryan and Andranik Kocharyan propose to make amendments to the laws on Military Service and Serviceman’s Status and on State Pensions. to increase the attractiveness and interest of contractual military service in certain military units of the RA Armed Forces. The proposal was debated at the deputies’ initiative during the NA extraordinary sitting on October 31.
Accordingly, the right to receive a military pension for long service is proposed to be preserved for the reservists who will return to contractual military service in the military units defined by the order of the Minister of Defense, but no more than under the condition of being appointed to a military position with the rank of lieutenant colonel.
According to the main rapporteur Armen Khachatryan, by the current law, the right to receive a pension is terminated upon military service in the relevant bodies after a military pension has been granted, except for the cases of enlistment in military service or being called to a training camp, as well as the cases of a penitentiary officer, enforcement officer of judicial acts, prosecutor, employee of the Investigative Committee, Anti-Corruption Committee in case of appointment to the position of a civil servant or judge.
Hence, he legislative package envisages establishing the right to non-termination of the appointed military pension for servicemen accepted for contractual military service in certain military units carrying out combat tasks of the RA Armed Forces defined by the order of the RA Minister of Defense, establishing the conditions for the appointment of the positions in such a military unit, in which case the right to receive a military pension for long service is preserved, including the cases of termination of that right, as well as to specify from the conscription military service or from the contractual military service in the military units defined by the order of the RA Minister of Defense or the procedure and conditions for recalculation of military pension after discharge from the training camp, deadlines for applying for recalculation.
As Armen Khachatryan informed, the adoption of the legislative initiative does not result in the additional financial funds in the state budget.
According to the co-rapporteur Vahagn Aleksanyan, the legislative package does not contain positive amendment.
Presenting the positive position of the Government, the RA Minister of Defense noted that the proposing regulations will promote the recruitment process of middle and lower ranks in certain military units.
The MPs inquired the Minister when the list of the aforementioned military units will be available and how the military will be able to get acquainted with it.
According to the Minister, the list of the sub-units will not be published, but the employees of the relevant sub-units of the Ministry will contact with the military, who wish and will inform.
The deputies of the opposition factions also expressed positive positions on the legislative package.
The National Assembly adopted the legislative package in the first reading.
The parliament debated the issue and also passed it completely in the second reading.
