On 26 June 2020 entered into force the amendments of the Constitution of the Republic of Armenia passed by the National Assembly of the Republic of Armenia on 22 June 2020. The Article 213 of the RA Constitution was written with the following edition: “Until entering into force of Chapter 7 of the Constitution the term of the powers of the member (judge) of the Constitutional Court appointed and been in office not less than 12 years with general duration in the post of the member or the judge of the Constitutional Court is considered terminated, and the tenure suspends” (Article 213, Part 1).

Taking into consideration the circumstance that the personal dossiers of the RA Constitutional Court judges (members) are preserved and carried on in the RA National Assembly, and studying the documents existing in the mentioned cases, we inform that the tenure of the following judges (members) of the Constitutional Court has suspended with the mentioned regulations.

Hrant Nazaryan, whose general duration of the term of the office as a member or a judge of the Constitutional Court until 26 June 2020 has been more than 24 years.

Felix Tokhyan, whose general duration of the term of the office as a member or a judge of the Constitutional Court until 26 June 2020 has been more than 22 years.

Alvina Gyulumyan, whose general duration of the term of the office as a member or a judge of the Constitutional Court until 26 June 2020 has been more than 12 years.

In accordance with Part 3 of Article 213 of the RA Constitution, the nominations for the vacant posts of three judges of the Constitutional Court shall be implemented successively within two months by the Government, President of the Republic and the General Assembly of Judges, which begins from 27 June 2020.

We also inform that in accordance with Part 4 of Article 213 of the RA Constitution Hrayr Tovmasyan’s tenure in the post of the President of the Constitution has been suspended. In accordance with Part 4 of Article 213 of the RA Constitution, the President of the Constitutional Court shall be elected by the established order of Article 166 of the Constitution, the election shall be held after recruiting the emerged vacant posts of the judges of the Constitutional Court.

Taking into consideration the fact that the President of the Constitutional Court is not elected yet, and the term of the powers of the Vice President of the RA Constitutional Court Alvina Gyulumyan as a member (judge) of the RA Constitutional Court has been terminated entering into force by Part 1 of Article 213 of the RA Constitution and the tenure has been suspended, the duties of the President of the RA Constitutional Court will be assumed by the oldest judge among the judges of the Constitutional Court. By 26 June 2020, the oldest judge of the RA Constitutional Court is Ashot Khachatryan, born on 10 September 1962.
