On March 19, the RA National Assembly convened an extraordinary sitting at the deputies’ initiative. The draft law on Making Amendments and Addenda to the Constitutional Law the RA Judicial Code authored by the deputies of the NA My Step Faction Vladimir Vardanyan, Anna Karapetyan, Artur Davtyan, Vahagn Hovakimyan and Sergey Atomyan was on the agenda with the enclosed package.

The key rapporteur Vladimir Vardanyan has informed that the goal of the package is to ensure the effective implementation of the examination of the judicial cases, the decent realization of the participants’ rights and legal interests, the provision of the demand to examine solving the cases within reasonable terms, the elimination of the consequences of the violations of the fundamental human rights and freedoms and the restoration of the rights of the victims of those violations. The court can apply it in the events, when the participants of the trial regularly speculates them while making use of their judicial rights. It is also proposed to endow the Supreme Judicial Council (SJC) with the authority of ensuring the regular activities of the courts, designing that the SJC will have the right to adopt normative legal acts.

The right is designed to address the SJC by the physical and legal persons for subjecting the judge to disciplinary responsibility, if the judicial case is with their participation.

Another amendment envisages to give authority to the SJC, in that framework three judges participant in the lottery for the examination of those cases will be elected among the judges of the given court for the examination of the criminal cases of certain complexity. The lottery will take place in the judges’ presence.

In case of adoption of the package, the SJC also will have power to take the case corresponding to the abovementioned standards from the judges, who have no necessary skills for examining such cases.
