Items on Military Leave, Publication of Personal Data of Officials and Other Items Debated in NA

There were five items for the compulsory debate in the first part of the NA draft decision on Making Addenda to the agenda of the sixth session of the NA seventh convocation, ten items - in the second part, which were endorsed, and three items - in the third part, which were not endorsed by the Head Committee.

Taron Simonyan presented the bill on Making Amendments and Addenda to the RA Law on the Military Service and the Serviceman’s Status authored by the Bright Armenia Faction by which it is proposed to rewrite the first sentence of the Part 16 of the law – “Soldiers who are discharged from the military service and soldiers who have unused vacations during the military service are compensated for all unused vacation days”.

The conclusion of the Government was negative. The key rapporteur noted that the bill had been in force for about seven months, but anyway, the Government did not respond and only in the Head Committee, he was proposed during the debate to postpone the debate for a month aimed at finding comprehensive solutions on the issue.

The co-rapporteur, the NA Deputy Armen Khachatryan underlined that the issue was not implementable in terms of finance and proposed his colleagues to refrain from including the bill in the agenda of the session.

The parliament rejected the bill by voting.

The NA Deputy Sergey Bagratyan with the legislative initiative on Making Addenda to the Constitutional Law of the NA Rules of Procedure proposed to give the Inquiry Committee opportunity to express distrust to the member of the Government who will be disrespectfully absent from the sittings of the Inquiry Committee. According to him, as a result of the addenda to the article the participation of the representatives of the Government in the sittings will be ensured, which will promote the efficiency of the works functioning and to be established Inquiry Committees and the proper implementation of the works by the officials.

According to the co-rapporteur, the NA Deputy Sisak Gabrielyan, the issue is completely regulated by the current legislation.

As a result of the debate, this bill was also rejected.

According to Ani Simonyan, with the draft law on Making Amendments to the RA Law on Corruption Commission Prevention authored by the Bright Armenia Faction it is proposed to publish the advisory conclusions on building integrity of persons to be appointed to state positions, the candidates for the members of the Supreme Judicial Council, the candidates for the judges of the Constitutional Court, the candidates for the judges as well as other cases established by the law.

However, according to the Public Service Law, they are not subject to publication. According to the NA deputy, not being the subject to publication contradicts the Part 1 of the provision of Article 42 of the Constitution on finding information, receiving and spreading, restricting freedom.

The Chair of the NA Standing Committee on State and Legal Affairs Vladimir Vardanyan has noted that the bill is a rough intervention of personal data and the solution of the problem gets more complicated.

The National Assembly rejected this issue by voting too.
