It is Proposed Not to Charge Costs in Case of Discontinuance of Enforcement Proceedings for Persons Who Died, Became Disabled, Unknown Missing or Recognized as Dead

At May 20 sitting of the NA Standing Committee on State and Legal Affairs, the draft law on Making Addenda to the RA Law on Compulsory Enforcement of Judicial Acts authored by the Government was debated in the first reading.

The RA Deputy Minister of Justice Vahe Danielyan presented the proposed amendments.

It has been noted that due to the announced martial law on 27 September 2020, the creditor including the banks and the loan organizations, in case of the existence of corresponding bases can forgive some debtors’ obligations (for example, the persons who died, became disabled, unknown missing or recognized as dead). Meanwhile, there are cases when the creditors forgive the debtors’ obligations referred to which enforcement proceedings have already been initiated, in case of which the expenses carrying out enforcement actions are charged and the bank should pay it. So, it is proposed not to levy the expenditures carrying out enforcement actions in case of discontinuing the enforcement proceedings.

The draft law was endorsed. The committee members, highlighting the presented amendments, proposed to debate the item on the agenda of the regular sittings for 24 hours.
