NA Standing Committee on State and Legal Affairs Convenes Extraordinary Sitting

On July 1, moderated by the Deputy Chair of the NA Standing Committee on State and Legal Affairs Anna Karapetyan, the extraordinary sitting of the Committee was held.

As the RA Deputy Chairman of Investigative Committee Arsen Ayvazyan presented, the package of draft laws on Making Addenda to the RA Law on Public Service and on Making Addenda to the RA Law on Remuneration of Persons Holding Public Positions and Public Service Positions authored by the Government was debated in the second reading.

The NA deputies did not present written proposals referred to the package, so it was not amended. The draft law was endorsed.

The Committee debated in the second reading the draft law on Amending the RA Civil Code authored by the NA deputies Nikolay Baghdasaryan, Tsovinar Vardanyan, Viktor Yengibaryan, Hayk Gevorgyan, Sergey Movsisyan, Gevorg Papoyan, Hayk Sargsyan, Hovik Aghazaryan, Hripsime Grigoryan, Sergey Atomyan and Hayk Tsirunyan.

According to the key rapporteur Nikolay Baghdasaryan, the proposed amendments will ensure the rights of both business entities and the citizens in the issue on the legalization of autocratically built buildings. At the same time, the community will have a right to dismantle autocratically built buildings without carrying out an administrative proceeding. It is also envisaged that the developer will completely bear the cost of dismantling the autocratically built buildings, no matter who implemented the works. The issue on the state registration of a real estate by the existence of autocratically built buildings is also solved by the draft.

The RA Deputy Head of the Cadastre Committee Arman Petrosyan, presenting the position of the Government, has noted that the executive body has no exception against the idea. However, according to him, in case of adopting the draft law by the presented form, it will cause problems during the implementation phase. Arman Petrosyan has underlined that the Government envisages to solve the problem more completely and will come up with a legislative initiative soon.

During the working discussion, it was decided to revise the draft law and turn it into a package of drafts, to replenish with the draft law on Making Addendum to the Administrative Proceeding Code. The co-rapporteur Artur Davtyan informed that the author accepted the proposal not to make amendments to the Civil Code, so he urged his colleagues to vote for the revised draft.

As a result of voting, the revised draft law was endorsed.
