At December 6 sitting moderated Armen Gevorgyan, the RA NA Standing Committee on Regional and Eurasian Integration moderated by Armen Gevorgyan, presented for debate the draft law on Ratifying the Agreement on the Order of the Non-Regulating Product Circulation with Technical Rules of Procedure of the Eurasian Economic Union and the Rules of Ensuring the Given Product Security within the framework of the Eurasian Economic Union. The Agreement was signed in 2020.

The document sets the order of the circulation of the product not included in the united list of the product within the framework of the EAEU, towards which compulsory requirements are set within the framework of the EAEU, but towards which the technical Rules of Procedure of the Union have not been adopted or entered into force. It has been noted 67 group of goods were included in the united list.

The regulations of the circulation of the product, used product – medicine, medical kinds of product being used for defensive purposes, the product being used for ensuring the defense and security interests are not regulated by the Agreement.

By the Minister’s proposal the Head of the Department of the Quality Infrastructures Development of the Ministry of Economy Zhanna Zakaryan presented the content of the Agreement. She has informed that the Agreement does not spread on the legal relations related to the use of the sanitary, veterinary-sanitary and quarantine phyto-sanitary means. In the Agreement the security of the mentioned product is provided by the legal persons or physical persons, who are registered as individual entrepreneurs, their authorized representatives, including by the producers, the authorized persons by the producer, the importers and sellers who carry out the production of the goods and realization in all phases of its span cycle (production, construction, installation, adjustment, operation, maintenance), in accordance with the legislation of the member states.

It has also been noted that the Agreement sets the comeback mechanism of the goods.

The responsibility for the circulation of the dangerous product and the circulation within the framework of the EAEU is regulated in accordance with the legislation of the member states.

The disputes on the use and comment of the Agreement between the member states are regulated by the order set by the treaty on Eurasian Economic Union. The signing of the Agreement does not suppose additional financial expenditures from the EEU member states.

As a result of voting the Committee members endorsed the draft law.
