Draft Law on Penalty Score System

At February 8 convened regular sitting, the parliament debated in the first reading the draft law on Amending the RA Code on Administrative Offences authored by the NA Armenia Faction, which was considered am extraordinary item by the decision of the Faction.

The key rapporteur, the RA NA deputy Gegham Manukyan has noted that the draft law proposes to recognize invalid the provisions of the RA Code on Administrative Offences, by which penalty score, as well as suspension of suspension of the right to driving transport means is applied towards the persons who have broken the road traffic rules.

The key rapporteur has noted that by the law in force the citizens’ rights are violated. According to him, by the RA Constitution the double responsibility for the same deed is banned. With the functioning regulations at the same time penalty on financial means, as well as on penalty scores is designed for the drivers. In case of running out of 9 points given to all drivers, suspension of the driver’s license arises. According to Gegham Manukyan, that is a means of separate responsibility, which is applied in parallel with other means of responsibility for the same deed.

The co-rapporteur, the member of the NA Standing Committee on Defense and Security Armen Khachatryan presented the position of the Committee. The deputy touched upon some statistical data, according to which, the score system has a positive influence on decreasing the road traffic accidents in Yerevan.

Regarding the claim considering anti-constitutional of the draft law, Armen Khachatryan has noted that issue can be disputed only in the relevant body, in the Constitutional Court. He called on the authors to dispute the constitutionality of the issue just there.

The RA Deputy Head of Police Ara Fidanyan presented the conclusion of the Government. According to the Deputy Head of Police, the functioning regulations fully correspond with the international legal principles, as well as the inner-state legal regulations.

Ara Fidanyan has underscored that with the functioning regulations double responsibility is not designed andhas proposed to leave the Articles of the Code in force unchanged.

In their speeches the deputies of the RA NA Civil Contract Faction have noted that the Article of the Constitution pointed out by the draft law related to ‘not to be adjudicating for the same deed.” And penalty score is applied for the legal offences with the regulations concerning the score system. With the regulations in force, the person is not subjected to responsibility for the previous legal offence, but in case, when regularly makes such violations, which are of danger for the society: as a result, the person is subjected to stricter responsibility.

On behalf of the RA NA Armenia Faction Artsvik Minasyan delivered a speech. He has noted that there are problems in the score system, and the presented draft law is aimed at voicing and resolving those problems. The deputy underlined that their Faction would apply to the Constitutional Court.

In their concluding speeches the RA Deputy Head of Police Ara Fidanyan, the member of the NA Standing Committee on Defense and Security Armen Khachatryan and the deputy of the NA Armenia Faction Gegham Manukyan answered to the voiced questions.
