It is Proposed to Increase the Amount of Fine in Case of Not Illegally Providing Information Stipulated by Law

The executive body proposes to increase the amount of the fine functioning for not illegally providing the information stipulated by law. It is designed to make the fine in the amount from 10-fold up to 50-fold of the established minimum salary from 30-fold into 70-fold, and in case of applying the same breach as an administrative penalty, make the penalty in the amount from 50-fold up to 100-fold of the minimum salary from 100 to 150-fold.

These regulations are proposed in the Code on Administrative Offences. Presenting the issue at May 24 sitting, the RA Deputy Minister of Justice Yeranuhi Tumanyants voiced the reasons and the bases of the legislative proposal. It was noted that, according to the statistics of the surveys posted on the website Givemeinfo.am, from 2019 until now no answer was submitted at all to the 3 percent of the surveys in written form addressed to those possessing the information, i.e. some information demanded by the survey were not provided, and in case 3 percent an unsubstantiated answer was received. In accordance with the study of the cases posted on the judicial information system Datalex.am, the lawsuits presented on subjecting to administrative responsibility on the basis of Article 189.7 of the Code, are not of big number.

According to the Deputy Minister, 10.000-50.000 AMD fine does not sufficiently interest the citizens to sue the legal entities against the state and local self-government bodies, state institutions, the organizations being financed from the budgets, as well as the officials of the organizations of public importance for not illegally providing information stipulated by law. According to Yeranuhi Tumanyants, while making decision for expediency of presenting a lawsuit on subjecting to administrative responsibility to the offender the person not received the information, realizes that he/she will waste more financial means, than the amount of fine in case of satisfying the lawsuit towards the person breaching the law and often does not make use of the right to submit a lawsuit in such way.

Presenting the endorsement of the NA Standing Committee on State and Legal Affairs, Lilit Minasyan opined that the initiative would promote the rise of the transparency of the activities of the state and local self-government bodies.

The parliament debated in the second reading the draft law on Making Amendments and Addenda to the RA Forest Code and the package of bills on Making Amendments and Addendum to the RA Criminal Procedure Code and on Amending the RA Criminal Procedure Code.
