A Number of Laws with Legislative Initiatives of Government Are Complied with EAEU Legislation

The draft on Amending the Law on Medical Aid and Service of Population and the enclosed package of draft laws is aimed at the specification of the regulation of the medical circulation of products, as well as the harmonization of the RA legislation with the rules adopted within the framework of the Eurasian Economic Union (EAEU) on it.

It is proposed to recognize invalid the Article 2.1 from 50 to 60 paragraphs of the law on Medical Aid and Service adopted in 1996, and to write with new edition.

In the sphere of the state regulation of the medical product circulation with one of the provisions the national body established by the decision of the Government carries out the examinations and professional observations. In the sphere the examinations are paid. The payments of the examinations are returned irrespective of their results.

In Armenia the production of the medical products is carried out in accordance with the standards of the International Organization for Standardization.

The producer invests and maintains the quality management system of the medical products, as well as provides its assessment, in accordance with the requirements approved by the decision of the Eurasian Economic Commission Council of November 2017.

The RA Minister of Health Anahit Avanesyan has noted that the aim of the amendments being proposed is also the adoption of the legal acts in accordance with the EAEU and making those acts as a part of the RA law. “This is an important step for having a quality system,” the Minister of Health said. He also informed that during the preliminary debates all proposals presented by the deputies were included in the legislative package.

The Committee members debated in the first reading the draft on Customs Regulation and the package of the draft laws, and the need of its adoption is conditioned by the EAEU Customs Code approved by the treaty of April 11, 2017 on Eurasian Economic Union Customs Code the legislation on the RA Customs Code, as well as the fact of the compliance with the regulations set out by other legal acts adopted within the framework of the EAEU.

The problem is that the law in force does not reflect the entire content of the provisions reserved to the regulation of the national legislations by the EAEU new Customs Code, as it was elaborated on the basis of the regulations of the EAEU new Customs Code, and the launch of the new legislative initiative is conditioned by the volume of the amendments under implementation and the change of the law structure.

It is proposed to define the regulations vested in the national legislation envisaged by the EAEU Customs Code and by other legal acts carried out within the framework of the EAEU customs sphere.

A number of already defined regulations will be clarified and the structure of the Law on Customs Regulation will be harmonized with the current EAEU Customs Code.

It is envisaged that the applications can be submitted to the customs bodies electronically in all cases.

A system for prepayments will be introduced for the implementation of payments on state duties, special, anti-dumping duties and compensation fees collected by the declarant for the customs duties, taxes and customs operations. “It will make the activity of businessmen comfortable,” the RA Minister of Finance Arman Poghosyan said.

It is also proposed to clarify the customs declaration system in case of transportation of goods in an unassembled form, including in incomplete form and create an opportunity to extend the period for submission of the customs declaration for the last component of completed and finished goods (according to Article 117.8 of the Customs Code of the Union – two months) for one year, and in case of need for additional extension - up to six years.

According to Arman Poghosyan, the adoption of the package of drafts will in fact regulate the relations vested in the national legislation of the EAEU member states on the Customs Code of the Eurasian Economic Union, will define the measures of responsibility in terms of offenses in the customs sector.

The NA deputy, the Committee member Khachatur Sukiasyan asked a number of professional questions about the existing problems in the sphere.

Arman Poghosyan proposed to organize working meetings related to those issues.

The legislative packages were debated and endorsed at the sitting of the NA Standing Committee on Regional and Eurasian Integration convened on May 30.
