With Proposed New Regulation, Foreigners to Be Given Opportunity to Have Same Rights While Working in Representative Office and Branches of Organization

MP Gevorg Papoyan proposes to reserve the right to work without a permit to the foreign employees of the representative office and branches of the organization in the Republic of Armenia. According to the current legislation, the employee of a representative office of a foreign organization is exempt from the work permit requirement, while an employee of a branch is not.

The NA deputy noted that recently, many foreigners living and working in our country are opening branches and representative offices, and when opening a branch, the latter are facing a problem. He underlined that there is also the legal position of the Constitutional Court on the discriminatory treatment of a person. According to Gevorg Papoyan, the discriminatory and differentiated approach lacks an objective basis. He added that the proposed regulation resolves the issue of protection of employee’s rights, it is also aimed at better response to existing economic challenges, promotion of investments and economic improvement.

The member of the NA Standing Committee on State and Legal Affairs Lilit Minasyan informed about the endorsement of the Committee in her co-report.

The Head of the Migration Service Armen Ghazaryan noted that there is no discriminatory approach, because both branches and representative offices of foreign organizations are registered as separate divisions in the state register of legal entities, and a unified approach is applied. “We are not against the proposal, which allows us to clarify the purpose of the law and the legislator in more detail,” he said.

Presenting statistical data, Armen Ghazaryan informed that 119 people from 27 companies have applied for residence status based on work, since the begging of this year.

MP Gevorg Papoyan proposes the proposed regulation in the Law on Foreigners. It was debated in the first reading at the sitting on November 15.
