Anti-Corruption Court of Appeal is to Be Proposed to Create with Legislative Initiative

The Anti-Corruption Court as a new specialized court by the law on Making Addenda and Amendments to the Constitutional Law the RA Judicial Code adopted on April 14, 2021. The law on Making Addenda and Amendments to the Constitutional Law the RA Judicial Code was adopted on February 9, 2022 to provide the effective examination on anti-corruption cases, by which the Anti-Corruption Chamber of the Court of Appeal was created. In the context of the presented legal regulations a situation was created, when specialized courts examining anti-corruption cases work in the First Instance and in the Court of Appeal. However, there is no separated court, where will examine those issues. On December 16, at the extraordinary sitting of the Standing Committee on State and Legal Affairs the RA Deputy Minister Armenuhi Harutyunyan said about this, presenting the draft law on Amending the constitutional law the RA Judicial Code and the enclosed presented package of draft laws.

The aim of the draft authored by the Government to provide the organization of the re-examination of the judicial acts held on anti-corruption civil and corruption crimes by the Anti-Corruption Court of Appeal.

As a result of the adoption of the draft, the Anti-Corruption Court of Appeal will be created. The court will consist of 12 judges, 6 out of them will be engaged with the cases on corruption crimes, and 6 – with the examination of the claims against the judicial acts held on the anti-corruption civil cases.

According to Armenuhi Harutyunyan, there will not necessity of adding the number of the new judges with the amendments.

The regulations on the list of the candidates of the judges, who are subject to advancement in the Court of Appeal will also be regulated by the draft.

The key rapporteur informed that numerous proposals were received from the deputy Arpine Davoyan, which were jointly debated and accepted.

The Committee Chair Vladimir Vardanyan informed that the Supreme Judicial Council (SJC) initiated a number of debates on the issues of the implementation of the judicial reforms. The legislative initiative was debated in detail with the representatives of the judicial power. He emphasized the adoption of the proposals for unburdening of the judiciary and implementing effective justice.

The co-rapporteur Arpine Davoyan briefly presented the proposing amendments.

In her final speech Armenuhi Harutyunyan thanked the MPs for the extensive work – for the proposals presented in essentially mitigating the loading of the judicial system.

The revised draft was endorsed.
