Addenda to Law on Aviation

According to the law on Aviation, the opportunity or authority to refuse the provision of any right or termination of the granted right in order to eliminate or avoid serious consequences for life, health or property of other persons, the state security or the protection of particularly important public interests, as well as persons with a bad reputation as an entrepreneur in the aviation sector, are excluded from the field of regulation of relations regarding the operation of the airplane. This was stated by the RA Deputy Minister of Territorial Administration and Infrastructure Armen Simonyan during the sitting of the NA Standing Committee on Economic Affairs convened on January 11, introducing the need to make addenda to the law on Aviation.

According to Armen Simonyan, the need to develop the draft law is due to the fact that in the process of giving the aircraft operator's certificate, an important requirement is to adopt the circumstance of an entrepreneur and a person with governmental powers over the legal entity having a bad reputation (a member of the board of the company, director, person with a large share, person responsible for operation, etc.), on which grounds it will be possible to refuse the provision of the certificate or, in case of the already granted right, to terminate it.

The Deputy Minister of Territorial Administration and Infrastructure, referring to the issue of baggage loss and flight delay, mentioned that it is regulated by international and national legislations.

The Deputy Chair of the Committee Babken Tunyan was interested in whether it is fair to deny a license to a person with a previous conviction, who currently lives a legal life, pays all taxes and is a worthy specialist, has a place on the board of any company.

According to the Deputy Minister, one of the grounds for license refusal is precisely that, which is defined by law.

The draft law has been endorsed.
