Parliament Debates Petition of Prosecutor General on Giving Consent to Initiating Public Criminal Persecution towards NA Deputy Armen Charchyan

“On January 20, 2023 the Supervising Prosecutor on the criminal procedure, being led by Article 38 of Criminal Procedure Code, proposed the Prosecutor General to apply the National Assembly for receiving consent to initiate public criminal persecution towards the NA deputy of the eighth convocation Armen Charchyan. The basis for introducing proposal was the study of the criminal proceedings at the Prosecutor’s Office, as a result of which it was found out that by the examination factual data were obtained, which give as a basis to initiate public criminal persecution towards Armen Charchyan by Article 338.2.1 of the Criminal Code adopted on April 18, 2003, i.e. for giving evident false conclusion on the criminal case related to the accusation on grave and especially grave crimes,” the RA Prosecutor General Anna Vardapetyan said at the RA NA sitting on February 8.

According to Anna Vardapetyan, during the pre-examination of the criminal proceedings evidence was obtained that Armen Charchyan, being Executive Director of Izmirlian Medical Center CJSC, Head of Department of Traumatology and Orthopedics of Yerevan Heratsi State Medical University (YHSMU), and being involved in the Committee of Double Committee Forensic Investigation Commission as an expert, appointed related to the accusations being proposed to Artur Sargsyan on the criminal case being examined in the special investigative service proceedings, on February 8, 2017 gave evident false conclusion of the Double Forensic Committee Examination.

The Prosecutor General presented the content of the false conclusion, Artur Sargsyan’s diagnosed diseases, including ankylosing spondylitis (Bekhterev’s disease), the accusations proposed to Artur Sargsyan, the diseases caused to death, and the results of the forensic examinations carried out posthumously. It was informed that during the pre-examination, experts were also examined, against whom criminal cases were initiated.

The RA Prosecutor General mediated to initiate public criminal persecution towards the NA deputy of the eighth convocation Armen Charchyan on the basis of the presented documents and being led by the relevant Articles of the RA Constitution, the Criminal Procedure Code and the constitutional law the Rules of Procedure of the National Assembly.

The deputies’ questions referred to the details of the experts’ conclusion and the probable possible customers of the case.

“The NA decision on Giving Consent to Initiating Criminal Persecution towards the Deputy is made by secret ballot,” the NA Vice President Ruben Rubinyan stated. The Chairman of the NA Counting Commission Narek Babayan presented the place, hour and order of voting: the voting will be held on February 9.
