Structures to be set: RA to be able to address the ECHR for receiving advisory conclusion

The Protocol 16 of the European Convention on Protection of Human Rights and Fundamental Freedoms gives an opportunity to the states, the Higher judicial instances to submit an application to the European Court of the Human Rights (ECHR) for receiving advisory opinion: the Deputy Minister of Justice Armenuhi Harutyunyan at April 13 sitting, presenting in the first reading the draft law on Making Addenda to the Constitutional Law on CC and the enclosed presented package of draft laws.

“Though the Republic of Armenia has already made use of the mentioned opportunity, established by the international treaty, nevertheless, the distinct procedures of use lack, that can create uncertainty, in terms of right process organization obstacles can arise. There was a need to amend the mentioned codes with regards to designing regulations,” the Deputy Minister underlined.

The inner-state structure of submitting an application for receiving ECHR advisory opinion.

The deputy of the Civil Contract Faction Mariam Poghosyan inquired from the Deputy Minister until when the Constitutional Court should discuss the proposal of submitting an application for receiving ECHR advisory opinion, and in response to this, Armenuhi Harutyunyan noted that distinct terms are not set.

The co-rapporteur Aruyak Julhakyan informed that since 2018, the RA repeatedly applied to the ECHR and in two cases received advisory opinion. The MP informed that the issue was debated at the Standing Committee on State and Legal Affairs and received endorsed.

The legislative package was approved by the parliament.
