The revision of the draft law on Making Amendments and Addenda to the RA Code on Administrative Offences stems from the necessity of creating appropriate preconditions for providing regular activity of the inspectorate bodies, specifying the framework of the bodies and the inspection bodies and administrative legal offences, as well as carrying out demands established by legislation in the control spheres of the inspection bodies and proper control for security. The Head of the Office of Coordination of Inspection Bodies of the Prime Minister's Staff Petros Martirosyan said about this at September 4 sitting, presenting for debate in the first reading the draft law on Making Amendments and Addenda to the RA Code on Administrative Offences.
The purpose of the draft is to set by the Code that the body investigating the cases on legal offences being made in relevant spheres and/or establishing responsibility towards that sphere is the inspection body carrying out control.
It is designed to establish administrative responsibility means for violating the requirements designed in the fields of labour, health care, food security and lithosphere.
Stemming from the degree of danger of some administrative offences and the need of effective use of principle of justice, the warning is envisaged as a kind of administrative penalty for legal offences, in some cases the review of the designed amount of the penalty, the framework investigating cases on administrative legal offences and the officials with authority appointing administrative penalties on behalf of inspection body is specified.
It is proposed to design unified regulation for impeding the implementation of the inspection bodies’ control carrying out control, not letting or removing the assignment (the ordinance, the decision, instruction) or violations, suspending activity or action or not fulfilling other administrative acts within the established term.
The Committee endorsed the draft.
The debate of the legislative package on Making Amendments and Addendum to the constitutional law the Rules of Procedure of the National Assembly and on Making Addendum to the RA Criminal Code included in the agenda of the sitting was postponed for two months. The deputies of the NA Civil Contract Armen Khachatryan, Andranik Kocharyan, Gurgen Melkonyan, Vahagn Aleksanyan and Hayk Sargsyan authored it.
