A draft regulating market legal relations debated in Standing Committee on Economic Affairs

The draft law on Market Control will define the spheres of oversight of the market control inspection body, the main principles of market control, the check-ups of the inspection body, the features and forms of the control carried out, the powers of the RA Government in the field of market control, as well as the rights and responsibilities of officials of the inspection body and business entities. The Inspection Bodies’ Coordination Bureau Head of the RA Prime Minister’s Office Petros Martirosyan said this during the regular sitting of the Standing Committee on Economic Affairs in the context of the report on the draft law on Market Control on September 5.

“The draft specified the forms of control carried out by the inspection body, which are the study and inspection carried out in accordance with the Law on the Organization and Conduct of Inspections in the RA”, the Inspection Bodies’ Coordination Bureau Head of the RA Prime Minister’s Office said.

According to the rapporteur, the draft defined the types of orders issued by the inspection body in case of violation of the requirements set by the RA laws and other legal acts and the RA international treaties ratified by the RA legislation. The obligations of the business entity were also clarified.

“The adoption of the draft will allow to regulate and make more efficient the inspection body’s risk management in the fields of production, import, export or wholesale trade of non-food products, precious metals, as well as industrial hemp, ensuring security, compliance with the requirements set by the legislation of the Republic of Armenia, as well as preventive measures implementation,” Petros Martirosyan noted.

The deputy of the Civil Contract Faction Tsovinar Vardanyan asked Petros Martirosyan what will change in the life of the department and the citizen after the draft, what the changes are aimed at, in response to which the Inspection Bodies’ Coordination Bureau Head said that the Government decided that it is better to have a law that will regulate all legal relations, and any businessman who wants to start or stop a business will find all the answers to his questions in the Law on Market Control.

“The notion of ‘dangerous product’ was introduced into the law. Until now, it did not exist and it was defined in the domain of comments which product is dangerous. The second innovation that businessmen can correctly imagine after defining the draft is product suspension and recall. While the recall of this dangerous product was done by request, the third change is the purchase of a test sample, sending it for examination, its recall and destruction if it is dangerous,” Petros Martirosyan said.

The Deputy Chair of the NA Standing Committee on Economic Affairs noticed that the NA Expertise Department made extensive observations on the draft, based on which amendments were made, all the proposals were adopted. Babken Tunyan also noticed that the procedure for holding the business entity accountable in case of violation of the law is not defined, whether it is possible to do this by amending the related laws, which was approved by the Inspection Bodies’ Coordination Bureau Head.

The NA Standing Committee on Economic Affairs endorsed the draft.

The Deputy Chair of the Committee Babken Tunyan stated that the draft law on Making Addendum to the Law on Tax Exemption for Activities Carried out in Border Settlements will be withdrawn from circulation by the deputy of the Civil Contract Faction Sergey Bagratyan, so the draft law will not be debated at the Committee sitting.
