Legislative initiative abolishes prohibition established by RA Constitutional Court and specifies a number of provisions

According to the key rapporteur, the Deputy Director of the RA National Security Service Andranik Simonyan, with the draft law on Making Amendments and Addenda to the Law on Service in National Security Bodies, the ban on membership of trade unions by the employees of national security bodies provided for in the Law on Service in National Security Bodies is abolished, ensuring the requirement of the RA Constitutional Court’s decision SDO-1683 of April 11, 2023.

According to the speaker, based on the analyzes made as a result of practical application, some legal regulations regarding the certification of the employees of the national security bodies are being reviewed.

According to the key rapporteur, it is planned that the servants appointed to the position of officer in the order of promotion are certified after the date of appointment to the position, not earlier than 3 and not later than 6 months, and until they are certified in the new position, they continue to receive the surcharge calculated for the previous position.

The regulations on dismissing the employees who have not successfully passed the certification, leaving them at the disposal of the personnel and, as a result, dismissing them from service, with the consequence of stopping the payment of the surcharge in case of not passing the certification, are being reviewed. Instead of applying twice a year, it is planned to apply once.

It is designed to conduct the attestations by the Commissions provided by the Government's decision defining the attestation procedure.

The scope of the decisions made as a result of the certification and the grounds for stopping the payment of the surcharge are clarified.

The grounds for reimbursing the state expenditures for education or training by civil servants are reviewed.

According to the draft, the authority to set the order and amount of reimbursement of educational expenses is assigned to the Director of the National Security Service.

The co-rapporteur, the MP Kristine Poghosyan emphasized the adoption of the draft law, and also presented questions, which were clarified by the key rapporteur.

As a result of debate, the Committee members endorsed the legislative initiative.
