Legislative initiative aimed at unloading the workload of courts

The goal of the legislative initiative is to set legal regulations and the comply them with the introduction of the electronic justice system.

The RA Deputy Minister Ara Mkrtchyan said at the extraordinary session of the National Assembly on December 22, presenting for debate in the first reading the draft on Making Addendum to the constitutional law the RA Judicial Code and the package of the enclosed draft laws.

According to the Deputy Minister, as a result of the adoption of the package of drafts it will be possible to draw up and submit all procedural documents: claims, complaints, etc, except the information containing state and office secret.

As Ara Mkrtchyan assured, the electronic case notion is introduced, which will include all the documents, which were formed or presented through the system.

It was noted that by the package legal persons, individual entrepreneurs, the state bodies, the local self-government bodies, the lawyers, the notaries and others will be considered as a person compulsory using the system.

Ara Mkrtchyan also documented that the proposing legal regulations pursue a goal to facilitate the loading of the courts, promote the quicker examination of the cases by using electronic tools, the saving of the participants of the courts and the trial, the ensuring of the examination of the administrative cases within reasonable term.

The RA Deputy Minister of Justice also answered the deputies’ questions, which referred to the security of the system and the problems of the sphere.

The NA Vice President Hakob Arshakyan inquired if we are going to deal with so called sensitive data, if the personal data will be on that platform.

The Deputy Minister clarified that the information containing state secret will be presented in document version. It was mentioned that the Civil procedure will be digitalized with the first phase. According to Ara Mkrtchyan, the security is provided with current standards.

In Hakob Arshakyan’s opinion, if any system can have sensitive data, then that system should bear responsibility for ensuring their security.

In response to that, it was also noted that responsibility is set for material damage.

The co-rapporteur, the member of the NA Standing Committee on State and Legal Affairs Lilit Minasyan presented the endorsement of the Head Committee and stated that great step is taken on digitalization, which stems from strategy of the system improvement of 2021-2026.

The deputy detailed what the electronic justice notion means. She also stressed the necessity of creation of the cyber security center.

During the exchange of ideas, the Deputy Chair of the NA Standing Committee on Defense and Security Armen Khachatryan expressed concern on the implementation separate digitalization of different spheres. The implementation of the united, comprehensive digitalization process was considered important.

In the opinion of the Chair of the NA Standing Committee on State and Legal Affairs Vladimir Vardanyan, the introduction of the digitalization united standards is important.

He also stated that by the adoption and implementation of the legislative package under debate the courts will be unloaded.

The issue was also debated in the second reading and approved by the parliament.
