At January 11 sitting of the Standing Committee on State and Legal Affairs the amendments and addenda being proposed to the Tax Code and law on Bankruptcy were debated. The RA Deputy Chairman of the State Revenue Committee Artur Manukyan presented the regulations.
The tax authority will get an opportunity to submit an application of compulsory bankruptcy on physical persons, and the debtor declared bankrupt to fulfil the tax obligations emerging during the bankruptcy proceedings.
According to Artur Manukyan, during the period from the first to the second reading the Government proposed to postpone the term of the law entering into force (January 2025). According to him, technical amendments were also made. It was noted that the document turnover electronically was regulated and issues regarding the calculation of judicial expenditures.
The co-rapporteur, the deputy Lilit Minasyan detailed that the amendments are aimed at facilitating the tax administration.
The addendum to the law on Penitentiary Service being under debate in the second reading is conditioned by the necessity of the correctional officers and the rise of the special teaching efficiency: the RA Deputy Minister of Justice Levon Balyan.
According to the key rapporteur, during the period from the first to the second reading there were no proposals and amendments.
The amendments being proposed to the law on Bankruptcy was also debated in the second reading. According to the RA Deputy Minister of Justice Ara Mkrtchyan, the initiative aimed at improving the bankruptcy process.
The draft from the first to the second reading was revised, taking into consideration also the observations of the Expertise and Analytical Department of the NA Staff. As a result of amendments, the Ministry of Hi-Tech was removed from the list of the ministries of providing information. The regulations related to the electronic auctions during the electronic proceedings were specified.
The co-rapporteur, the Committee member Lilit Minasyan noted that the initiative completely refers to the procedure of the bankruptcy proceedings, beginning from the initiation until the end of the proceedings. The deputy proposed to vote for the draft.
As the RA Deputy Minister of Justice Ara Mkrtchyan presented, the Committee debated in the second reading the bill on Making Amendments and Addenda to the RA Criminal Code and the enclosed package of bills. It was noted that from the first to the second reading the Government presented two amendments.
The co-rapporteur, the Committee member Arpine Davoyan informed that she presented oral proposals. According to the MP, it is expected that the amendments will promote to ensure the specialization of the anti-corruption institutional systems and the examination of the cases within reasonable terms, as a result of which, the fight against money laundering will be improved. The representative of the Government considered admissible the MP’s proposals.
The draft law on Making Addenda to the RA law on Public Service, presented by the RA Deputy Minister of Justice Levon Balyan, was also debated in the second reading. It was noted that, as result of draft adoption a number of problems practically caused, regarding the change of the superior (or) direct head of the person holding administrative position, as well as the change of the Minister or the community head, the use of the structure of the person holding administrative position and the Minister and the Deputy Head as acting heads in the relevant positions will be solved.
After passing in the first reading the draft was not amended. The Committee endorsed the debated issues.
The debates of the legislative packages designing addenda and amendments to the law on State Property Management and to the laws enclosed to them were postponed up to two months.
