Government proposes amendments in RA Penal Code

The draft proposes to establish an authorizing norm in the RA Penal Code, which will enable to regulate in more detail the procedure for assessing the risks and needs of convicts by the order of the Minister of Justice. The RA Deputy Minister of Justice Levon Balyan said this at the extraordinary sitting of the Standing Committee on State and Legal Affairs on July 10.

According to the rapporteur, the effective implementation of risk and needs assessment of imprisoned persons is of key importance in the field of criminal justice and penal system reforms.

According to the next regulation, it is planned to transfer the convicts who need long-term medical assistance, service and care in hospital conditions to correctional hospitals . Levon Balyan noted that the specifics of the conditions for keeping the convict in correctional hospitals will be defined by the internal regulations of the penitentiary.

The penitentiary service will ensure the order and conditions of the execution of sentences in the medical penitentiary.

The Deputy Minister answered the MPs’ questions regarding the amendments proposed by the initiative.

Welcoming the idea of ​​ the initiative, the co-rapporteur, MP Arpine Davoyan opined that it should have been debated together with the Standing Committee on Health Care. The MP considered unacceptable the debate of the bill, which envisages such important amendments, in the format of an extraordinary sitting. According to the rapporteur, there are many questions that cannot be answered in a short time.

The bill providing for addenda and amendment in the Penal Code of the Republic of Armenia, debated in the first reading, was approved by the Committee.
