On February 6 the National Assembly continued the work of the four-day sittings by the debate of the draft law on Government Formation and Resignation. As Mr. Tigran Torosyan, President of the National Assembly, assessed a negligent approach was shown towards this draft. Based on the provisions of the
Constitution, the thorough description of the mechanisms of the formation and resignation of the government should be reflected in the draft. But it was done just to the contrary assessed Mr. Tigran Torosyan – the Constitutional norms only partly were placed in the draft, for example, the consultation part of the parliamentary forces in nominating prime minister is missed. While reading the draft, an impression is created that the Constitution was not amended, but the worst mechanisms are invested, said Mr. Tigran Torosyan, President of the National Assembly. Some provisions of the Constitution are envisaged to come into force after the parliamentary elections, noted Mr. Tigran Torosyan, President of the National Assembly and emphasized the importance of the full realization of those provisions. Mr. Tigran Torosyan, President of the National Assembly, considered unacceptable the adoption of the draft in that shape - especially three months before the elections. Taking into account the shortage of
time, Mr. Tigran Torosyan proposed to adopt the imperfect draft through the first reading provided that the gaps will be eliminated during the second reading. And the head of the ULP faction considered that in the submitted draft, the conditions concerning the citizenship of a member of the Government should be
precisely formulated. The main speaker Mr. Gevorg Malkhasyan, Deputy Minister of Justice, expressed readiness to submit in the second reading the most consonant draft with the provisions of the Constitution taking into account the sounded remarks.
The Deputy Minister submitted another legislative draft of the Government on Making Addenda and Amendments to the RA Civil Code, which clarifies the civil responsibility, in particular, cases of indemnification.
For the adoption for the second reading the parliament debated the draft Judicial Code of the Republic
of Armenia together with the draft on Making Addendum and Amendment to the Law on Conscription and the draft law on Putting into Force the Judicial Code of the Republic of Armenia. Mr. Davit Harutyunyan, Minister of Justice, noted that there are numerous proposals received from the
Government and parliament after the first reading. There are essential differences in comparison with a preliminary variant.
With the package of the draft amendments to the law on Prosecutor’s Office and relevant three laws the government aims to introduce a new system of Prosecutor’s office.
The debate of the draft will proceed on February 7, as it is envisaged by the Rules of Procedure of the
National Assembly.
