At June 24 press conference, the Head of the RA NA Bright Armenia Faction Edmon Marukyan and the member of the Faction Taron Simonyan touched upon their decision of applying to the Constitutional Court (CC) on the violations noticed in the process of the adoption of the draft law of the Constitutional amendments at the NA extraordinary session.

Taron Simonyan has noted several bases, and the first one out of them is that in case of the Constitutional amendments being passed in the first reading by the NA to the second reading shall be sent to the Constitutional Court for the conclusion. “This is an evident violation, and this item shall become a matter of debate,” the MP noted, adding that the Article 86 of the Constitutional Law the NA Rules of Procedure gives a procedure how applying to the Constitutional Court shall take place. In the speaker’s opinion, however, that has been interpreted in a different way by the representatives of the political power.

The next violation, according to Taron Simonyan, is that by the amendments of the NA Rules of Procedure law passed by the NA, the President of the Republic has been deprived of signing and the right of issuing the Constitutional amendments. The speaker has noted that one of the bases that is established by the Constitution and the law on CC. The argument around the authorities of the Constitutional bodies is if the NA had the right not to apply to the CC or not. As to Taron Simonyan, the Constitutional Court is the body to answer to the questions.

Edmon Marukyan has informed that at this phase the Bright Armenia is not joining the Prosperous Armenia for signature collection to apply to the Constitutional Court. He clarified that when the draft law of the Constitutional amendments was under debate, the Constitutional Court had removed from suspension the case related to the RA second president Robert Kocharyan and appoint a day for its investigation.

“In order an impression is not created in any way that the Bright Armenia party intervenes into this process, the Faction had made a decision to apply to the CC after the investigation of the second president’s case. The works on application have been already begun,” the Head of the Faction said.
