It is proposed to regulate the issue on premiums being set towards the office rate of the Supreme Judicial Council (SJC) with the addenda to the law On Remuneration of the Persons Holding State Positions and State Service Positions. In the remuneration of the SJC members there will be equality irrespective of the circumstance the latter is elected by the General Assembly of Judges or by the National Assembly.
The RA Deputy Minister of Justice Armenuhi Harutyunyan noted that by the Judicial Code the remuneration of the SJC member is established by law and cannot be less than the remuneration of the Judge of the Court of Cassation. But the regulations established by the Judicial Code are not reflected in the law. According to Armenuhi Harutyunyan, premium in the amount of 50% of the office rate is provided in the order established by law to the Chairman of the Court of Cassation, the Chairman of the Chamber of the Court of Cassation, which in case of the SJC Chairman, Member is not in force.
After the first reading there were no proposals.
The issue was debated at the extraordinary sitting of the NA Standing Committee on State and Legal Affairs on December 15.
The Committee Chair Vladimir Vardanyan specified that the goal of the draft to provide the status legal equality of the entities working in the same body, as well as the equality on remuneration.
The draft was endorsed by the Committee.
The Committee Chair Vladimir Vardanyan proposed amendments to the RA Criminal Procedure Code. It is planned to postpone the term of having in action the Criminal Electronic Institute on the inter-judicial proceedings. According to the author, it will give an opportunity to raise the through long-term, pilot experiment of the concrete criminal proceedings and rectify all possible shortcomings, to solve the security operation issues of the system for avoiding the further negative consequences. It is proposed by the draft also to postpone the examination of the cases in the Anti-Corruption Annex of the current and examining cases at the phase of the formation of the Anti-Corruption Committee until January 1, 2024. Vladimir Vardanyan expressed hope that during that period the Anti-Corruption Committee will be completely re-equipped and the work approbation related to the electronic criminal proceedings.
The RA Deputy Minister of Justice Arpine Sargsyan presented the positive viewpoint of the Government.
