Speech by Member of RA NA Delegation to PACE Naira Zohrabyan at PACE Autumn Session

“Dear Colleagues, the genocides, to which we witnessed, the crimes committed against ethnic Yezidis, military crimes and crimes against mankind by the ISIL in the Northern Iraq, unfortunately, today are continuing. Thus, the elaboration of more flexible mechanisms of cooperation with the International Criminal Court is really an important problem. Yes, I agree with the Rapporteur that our Assembly should approve its commitment to fight against impunity and support the International Criminal Court.

Dear Colleagues, during the April military aggression unleashed by Azerbaijan not only soldiers were severely tortured, killed, beheaded and dishonoured, but also civilians, children, military technique banned by International Conventions was used. The tortures not being in any way understood in human being’s conscience, the beheading of the dead bodies and living people are the biggest abuses of the international humanitarian rights, which suppose distinct responsibility. What happened is undoubtedly a military crime, which is under the jurisdiction of the International Criminal Court.

Dear Colleagues, it is understandable that both the Nagorno Karabakh Republic and Armenia as a warrant of Artsakh security will do their best for recognizing Azerbaijan as military criminal. At the beginning of April a criminal case had been already filed by the NKR Prosecutor’s Office, by which it was approved that the military forces of Azerbaijan violated the ceasefire agreement signed by Nagorno Karabakh Republic, Azerbaijan and Armenia in 1994. During the first days of April war by the use of the land troops, air force, rocket-artillery and military technique Azerbaijan implemented an aggression against the NKR, violating the territorial integrity of Nagorno Karabakh Republic as an Agreement party. The Azerbaijani armed forces, grossly violating the norms of the international law, by the use of the banned means of war, violating the norms of the international humanitarian law, made the peaceful settlements being in deep rear, the civil population, schools, and buildings objects of attack, which caused numerous casualties being under protection of international law, including children. Of course, Azerbaijan, has not yet ratified the Rome Statute, but the same Statute designs that the UN Security Council can also apply to that Court, and the Prosecutor of the International Criminal Court is authorized with his initiative to file a criminal case.

Dear Colleagues, Azerbaijan should be recognized a military criminal and most of you are aware of the Azerbaijani raiders’ atrocities. So, don’t keep silence! Don’t keep silence yourself, dear Rapporteur, that you announce as if severe fight against impunity and military crimes should be displayed.”
