Draft Law Against Construction of Autocratically Built Buildings

On June 30, the draft law on Amending the RA Civil Code authored by the NA deputies Nikolay Baghdasaryan, Tsovinar Vardanyan, Viktor Yengibaryan, Hayk Gevorgyan, Sergey Movsisyan, Gevorg Papoyan, Hayk Sargsyan, Hovik Aghazaryan, Hripsime Grigoryan, Sergey Atomyan and Hayk Tsirunyan was debated in the first reading, the adoption of which was conditioned by the existence of illegal constructions. By the authors’ opinion, if the amendments adopted then no more autocratically built buildings will be built in Armenia. According to the substantiation, a practice was formed in previous years, when business entities and physical entities carried out construction without a construction permit, and then they applied to the head of the community for legalizing automatically built buildings. The reason is that the legalization of the unauthorized constructions is carried out more quickly and it is more affordable than legally obtaining a construction permit.

In Q&A format, the rapporteur Nikolay Baghdasaryan has clarified that after the adoption of the draft, any structure, autocratically built on the state or community land will not be the subject to legalization and will be dismantled.

The MP Artur Davtyan informed that the NA Standing Committee on State and Legal Affairs did not endorse the draft law. The deputy, in his turn, thinks that the draft will not solve the problem at which it is aimed. In his opinion, the owner of the land should manage the future fate of an autocratically built building, deciding whether to dismantle the structure or use it for another purpose.

The position of the Government was also not positive. The RA Deputy Head of the Cadastre Committee Arman Petrosyan has been noted that numerous provisions of draft are disputable, in particular, it is not specified what will be the fate of the automatically built buildings, some of which are located on state or community lands. It is also not specified how it will be decided when the automatically built building was built, as, according to the draft, the buildings built after the adoption of the law will be the subject to demolition.

He urged the parliamentarians to refrain from adopting the draft law.
