Proposed Amendment to Contribute to Proper Fulfillment of Responsibility of Airline to Passengers as Defined by International Standards

The proposed amendment will define the requirements for the acceptance of transportation with false travel documents on the flight operated by the carrier, for the acceptance of transportation in violation of the requirements of international medical and sanitary rules and related provisions, as well as the carrier’s liability requirements for ensuring the safety and care of passengers from the moment of leaving the plane at the landing airport to the time of crossing the state border of the country. Proper care of the arriving passenger will also be provided by the carrier. A fine of five hundred times the minimum salary will be imposed for non-fulfillment of the mentioned requirements, which will contribute to proper fulfillment of responsibility of the airline to the passengers as defined by international standards.

The requirements from the Chicago Convention on the Liability of the Carrier are not fully defined by the Article Liability of Carrier of the current Law on Aviation. Therefore, in order to complete the liability of the carrier, it is necessary to fill the gap in the law, as well as, as an ICAO Member State, to fulfill the requirements of the standards defined by the Chicago Convention and adopted by the RA. The RA Deputy Minister of Territorial Administration and Infrastructure Armen Simonyan noted during the sitting of the Standing Committee on Economic Affairs on September 7, presenting the package of draft laws on Making Addenda to the Law on Aviation and on Making Addendum to the Code of the Republic of Armenia on Administrative Offenses.

The debated draft was endorsed.

The issue on ratifying Common Aviation Area Agreement between the Republic of Armenia, of the one part, and the European Union and its Member States, of the other part was also debated at the sitting of the Committee, which was also presented by the RA Deputy Minister of Territorial Administration and Infrastructure Armen Simonyan.

According to the agreement, it is envisaged to create a common aviation zone, ensuring access to the markets of the parties under equal competitive conditions, without discrimination and under unified rules, including in the fields of flight and aviation safety, air traffic control, competition, social and environment. The common aviation zone will also allow to expand air communication and develop the international aviation system, based on non-discriminatory, transparent and fair competition between airlines in the market. According to the Deputy Minister, the ratification of the agreement will promote the development of trade, tourism, investments and socio-economic spheres, providing wider opportunities for mobility.

The voting on the issue was postponed for up to two months in order to discuss some issues in a working format.
