The NA Extraordinary Sitting

   On the initiative of the MPs, according to the 70th article of the Constitution, on June 15, the extraordinary sitting was begun in the National Assembly.


   
The MPs pursued the interrupted in the previous sitting debate of the bill on Approving the Annual Report of  2005 State Budget Execution.

   Presenting the positive conclusion of the Central Bank on  2005 state budget execution,    Tigran Sargsyan, the Chairman of the CB, turned on a number of key problems, which hamper the economic active development.

   Gagik Voskanyan, Chair of the NA Control Chamber, touched upon the fixed indicators of the state budget execution income and deficit parts.

   Also the NA Standing Committees expressed their positive viewpoints on the report.

By the presentation of Gagik Melikyan, MP, the RPA faction highly evaluates the RA Government activity, the witness of which is the 14% of economic growth which  is the result of the consistent and purposeful  work of the years. According to the faction “Ardarutyun”   a breach of  law on NA Rules of Procedure was taken place. Viktor Dallakyan, secretary of the faction, mentioning the 87th article of the NA Rules of Procedure, noted that the debate and the affirmation of the annual report of the budget should have taken place during the second Wednesday of June before the current year.

  Tigran Torosyan, NA Speaker, in his extraordinary speech agreed that in the result of prolonged report, the relevant article of the Rules of Procedure was violated for several hours, which is conditioned with the imperfectness of the Rules of Procedure concerning the terms and formulations. After the amendment of the Constitution the National Assembly hasn’t also changed the Rules of Procedure yet. Conceptual part of the issue is essential. Is the citizen in our country satisfied with the budget execution or not? Not a single word of criticism is mentioned by the opposition, which talks on budget execution. The growth of 14% of GDP is impressive.

   Comparing the current condition of economics with the indicators of previous years, Mr. Torosyan noted that economic progress is evident even if we try not to see it, but is it satisfactory? The country has reached the level of 1989 by the GDP(Gross Domestic Product), but a great number of citizens hasn’t reached that level yet, which is of great concern, incomes are increasing but the distribution is polarized, this is the direction the NA and RA should work in. One should be realistic, should point out both  and the enrichments and unsolved problems, thus providing honorable life for the RA citizens.

   Tigran Torosyan, the NA Speaker, considers the presented report the result of the government’s work, also mentioning the numerous unsolved issues, which should be overcome through everyday consistent work.


       
Vardan Khachatryan,  Minister of the Ministry of Finance and Economy in his completing speech observed the indicators of previous years’ state budget fulfillment, the recorded economic developments in separate spheres, that is the 14% of economic growth. In the result the state budget in revenue part is fulfilled in 108,5 %, in expenditure part in 105,8 %. Mr. Khachatryan thanked for the interested debates and assured that during the report of 2006 budget execution the useful proposals of CB, CC and the MPs should be taken into consideration. 
  
The MPs debated the bill on Making Amendments and Addendum to the RA Criminal Code, the adoption of which, according to Artur Osikyan, Deputy Head of the State Tax Service Adjunct to the RA government, is conditioned with the necessity of punishment review for a number of economic crimes. 
  
By the estimation of Rafik Petrosyan, Chairman of the NA Standing committee on State and Lega l Affairs, the issue has two parts, on one hand  it proceeds from the management’s interests on the other hand the state interest is functioning. The committee is for the economic responsibility threshold to be raised and the criminal responsibility  to be reduced as far as it is possible. Mr. Petrosyan informed that  the committee should represent its proposals before the second reading and should defend its approaches. 
  
The OYK faction is against the Criminal Code Amendments said Mher Shahgeldyan in his speech. Gurgen Arsenyan, Head of the faction ULP, being against the stratification of society, emphasized that by the Constitution the RA citizens have equal rights and responsibilities. 
  
In his extraordinary speech, Tigran Torosyan, NA Speaker, considered favorable the envisaged thresholds for responsibility to  increase  i.e. the 200 fold damage of salary to make 1000 fold: “this is the very threshold which is considered the current supreme damage. People who caused great damages, today face more light demands.  Our colleagues, who are opposition and offer those thresholds to be increased I think there’s a logic, for example the great amount of damage to become the 2000-fold of the minimum salary and the 10.000 to become 20.000 fold or a bit more.” According to NA Speaker, due to the project the condition of the citizens causing less damage to the state will be  released and vice versa. In case the project is not adopted, Mr. Torosyan expects the punishments which already exist by the Criminal Code, i.e. more hard punishments than the project considers for those who deal with small business. “If we want the punishment to be released for those who deal with small and medium business and to increase the punishment for those who cause big damages, we  should be for this  project. If we are for the entrepreneurs dealing with small and medium business, who can cause less harm  to the state to be under big punishments so naturally  we  are to reject the project, concluded the NA President.
Also Vahan Hovhannisyan, NA Vice Speaker took an extraordinary floor. Touching upon the sounded facts, Vahan Hovhannisysn opined that it is the weak who are to be damaged and not the rich. The Vice Speaker of the parliament recorded that in that case also the envisaged punishments for murder, rape should be reviewed, because the strong will be in more prevailing position. Mr. Hovhannisyan highlighted the means of punishments towards everybody for to be equally implemented. “It is not as if  the punishment is cruel but its equally implementation towards everybody is cruel.” Vahan Hovhannisyan certifies that the ARF faction is for the adoption of the bill. 

   The parliamentarians adopted by voting the bills on Declaration of Incomes and Property of Physical Entities and on Making Amendments to RA Law on Income Tax, on Copy Right and co Right, on Making Amendments and Addendum to RA Civil Code, on Making Amendment to RA Criminal Code, on Making Amendments and Addenda to the RA Law on Administrative Offences, on Making Amendments and Addendum to t he RA Criminal Code, on Making Amendment to the RA Law on Higher and Post Graduate Specialized Education, on Making Addenda to RA Law on Organizing and Processing Oversight in the RA, on RA Flag, on RA State Coat of Arms, on Making Amendments to the RA Law on Criminal Execution Service, the Package on Making Amendments and Addenda to the law on Compulsory Execution of Judicial Acts and affirmed the Annual Report of RA 2005 State Budget Execution. The National Assembly also made a resolution on  debate of special order of a number of bills. The parliament debated the MPs G. Sahakyan’s and G. Arsenyan’s authorized draft law on Making Amendment to RA Law on Higher and Post Graduate Specialized Education.  
   
Levon Mkrtchyan, Minister of Education and Science,  in his co speech emphasized that the  paying system should be observed as a business of education, where the foreign currency rate fluctuations should not  influence on tariff payment change of the education. 
 
The MP R. Grigoryan was concerned with the necessity of review of education fare in case of USD devaluation. By the assurance of the Minister of Education and Science, from this year on the education fare should be defined by AMD. Gurgen Arsenyan added that from July 1st 2005 the USD listing was banned by the law on Currency Oversight.
  
The MP Hranush Hahobyan emphasizing the adoption of the draft,  assured that the rectors o f the higher educational institutions are to respect  the law and not change the fare in the result of USD devaluation.

   The NA Standing Committee on State and Legal Affairs and the NA Standing Committee on Financial-Credit, Budgetary and Economic Affairs endorsed the bill.

   The bills on Making Amendments to the RA Law on  Criminal Executive Service, on Making Amendment to the RA Criminal Code, on Declaration of  Property and Incomes of Physical Entities, on Making Amendments to the RA Law on  Income Tax, on Making Addenda to the RA Law on Organizing and Processing Oversight in the RA, on Making Amendment to the RA Law on Higher and Post Graduate Specialized Education, on the RA  Flag, on the RA Coat of Arms and the Package on Compulsory Processing  of Judicial Acts were debated through the second and third reading procedure.
By the proposal of the authors the second and third reading debates of the bills on Making Amendment to the RA Law on Higher and Post Graduate Specialized Education, on Declaration of  Property and Incomes of Physical Entities, on Making Amendments to the RA Law on  Income Tax, on Making Addenda to the RA Law on Organizing and Processing Oversight in the RA were postponed.

Exhausting the agenda, the NA extraordinary sitting finished the works.
