Investment Attractiveness in Sphere of Lithosphere Use to Rise on the Legislative Initiative of Government: Hovhannes Harutyunyan

On the legislative initiative of the Government an attempt is made to regulate a number of problems existing in the RA Code on Lithosphere, including the legal relations connected with postponement of the term of the right to lithosphere use emergence because of transferring the right and emergence of insurmountable force.

Insurmountable force is considered to be the fires, the floods, the earthquakes, the storms or natural disasters, as well as the explosions, the war, the terrorism, the civil war, the civil mass obedience, which the lithosphere user could not predict, prevent and because of that the lithosphere user did not fulfill or did not non-decently fulfill the obligations. The RA Deputy Minister of Territorial Administration and Infrastructure Hovhannes Harutyunyan noted about this.

The legal relations connected with the materials being presented entomological examination will also be regulated. The definitions of the order, forms and filling in the guidebooks of submitting the annual report on the move of the minerals will be fixed.

In response to the question of the Committee Deputy Chair Babken Tunyan, Hovhannes Hrutyunyan noted that the issues were debated with the representatives of the concerned organizations of the sphere beforehand, who positively responded for that.

During the debate the Committee members Tsovinar Vardanyan and Mkhitar Zakaryan presented proposals, which were considered acceptable by the key rapporteur. The first proposal related to the extension of the terms of the right in case of the emergence of the insurmountable force, the second one was the change of their status in using the border lands.

The Committee members endorsed the bill.

Let us note that before passing to the agenda item, the Chair of the Standing Committee Vahe Hakobyan proposed the attendees to postpone the debate of the bill.

The key rapporteur did not find expedient the postponement of the debate of the item, noting in the term of the content it has not been changed: only explanation of several terms was increased. The Deputy Minister agreed with the proposal of the deputy Hovik Aghazaryan, and the preliminary version of the draft law was put under debate. After clarifications Babken Tunyan has noted that he does not see any problem related to the economic expediency of the bill and has added that there are sufficient no reasons to postpone the item, especially the deputies have one-month time for presenting their observations. He also advised the key rapporteur to continue the joint debates on some provisions with the NA Expertise and Analytical Department.
