The package of draft laws on Making Addendum to the Civil Code of the Republic of Armenia and on Making Addendum to the Law on State Border proposes to give the leaseholder and the lessor an opportunity to set out the right to cross the border by the transport means being subject to leasing or its restriction by the leasing contract. It is envisaged to introduce similar regulation in the Law on State Border.
The problem is that the current legal norms do not completely regulate the practical issues related to crossing the RA border by the transport means being subject to leasing by the leaseholder or a person authorized by him/her. As a result, the leaseholder can cross the RA border by the transport means being subject to leasing at any time, thus jeopardizing the liquidity of the transport means being subject to leasing. The draft law establishes a dispositive regulation, giving the leaseholder an opportunity to cross the border of our country exclusively with the lessor’s consent, thus minimizing the risks of possible loss of the transport means being subject to leasing.
The RA Deputy Minister of Justice Grigor Minasyan noted that after the first reading, the Government presented technical proposals, which were accepted.
In his speech, the Chair of the NA Standing Committee on State and Legal Affairs Vladimir Vardanyan stated that the package will be reviewed based on the proposals of the NGOs and the representatives of the civil society. He urged his colleagues to vote for the draft.
The legislative package was endorsed.
The legislative initiative of the Government was debated at the April 21sitting of the NA Standing Committee on State and Legal Affairs.
