Parliament Debates Third Petition of Prosecutor General on Giving Consent to Initiating Public Criminal Persecution towards NA Deputy Seyran Ohanyan

During the period from April 14, 2008 until September 9, 2016, Seyran Ohanyan holding the position of the Minister of Defense, stemming from the group interests, made use of the official position against the service interests, did not fulfill his service duties, which carelessly caused grave consequences. The RA Prosecutor General Anna Vardapetyan noted presenting third petition of the RA Prosecutor General on giving consent to initiate public criminal persecution towards the NA deputy Seyran Ohanyan.at the NA sitting on February 8.

The Prosecutor General clarified that the accusation is about the fact how the territories belonging to the carpenter company was passed to the private person.

A contract not beneficial for the state was signed with the relevant company, and containing provisions giving evident advantage in the civil-legal relations for the members of the criminal group, because of which the state was deprived of the opportunity of undertaking effective measures on their recovery in case of violating the obligations of the contract. Favourable conditions were created for the criminal group to loan the properties of the subject of the treaty and grab the considerable part of the received sum of money as a result of loaning, 1 billion 83 million 890.000 drams, and the Ministry of Defense by the decision of 2015 of the Court of the General Jurisdiction of the Centre and Nork Marash Administrative regions of the City of Yerevan, as a creditor not provided by loan, was registered only on the fourth place of the creditors with 8 billion 581 million 279.286 drams, in that way being deprived of the possibility of receiving payment for the alienated state properties or returning the alienated properties by the force of law.

“Taking as a basis the proposal of Supervising Prosecutor on applying to the RA NA for receiving consent to initiate public criminal persecution towards the NA deputy of the eighth convocation Seyran Ohanyan and being led by Article 96 of the RA Constitution, the Article 37.1.9 of the Code of the Criminal Procedure, the Article 108 of the Constitutional Law the NA Rules of Procedure, I mediate to give a consent on initiating public criminal prosecution towards the NA deputy Seyran Ohanyan,” Anna Vardapetyan noted, concluding her word.

The deputies’ questions referred to the framework of the persons inter-related to the case, the disclosure of those guilty, the involvement of the banking system to the case and other details. During the debate a reference was made to use for the state the grabbed sum of money, the importance of directing the solution of the social problems, which, however, was not made.

In response to the amount of the damage caused to the state, Anna Vardapetyan specified that less than 5 billion 884 million 300.000 drams was paid for the properties with 6 billion 664 million 300.000 drams.

The NA decision on Giving Consent to Initiating Criminal Persecution towards the Deputy is made by secret ballot. The Chairman of the Counting Commission Narek Babayan presented the place, hour and order of voting.
